The Pole Temple

1. APPLICABILITY

1.1 These Terms and Conditions apply to all agreements with and activities at The Pole Temple.

1.2 With the online registration and/or payment for a class, class package, membership, course, workshop or camp the client agrees with the Terms and Conditions of The Pole Temple.

1.3 The Pole Temple can change the Terms and Conditions at any time. The most recent version will be valid and this one will always be available on the website.

2. GENERAL

2.1 When a client fails to comply to the Terms and Conditions, The Pole Temple is allowed to refuse services to the client.

2.2 When a client, a collaborator, an employee or a freelancer is not deemed a good fit (anymore) for The Pole Temple, for any reason, The Pole Temple reserves the right to terminate the relationship immediately without any need for justification. For clients, a refund may be considered. The termination will be communicated in written form by email.

2.3 When a collaborator, an empoyee or a freelancer deems that The Pole Temple is not a good fit for them anymore, they have the right to terminate the relationship immediately. By doing so, they agree to forfeit any right or claim to a refund or financial compensation, for any reason whatsoever. The termination of the relationship has to be communicated in written form by email at jessica@thepoletemple.com as soon as possible.

3. PERSONAL DATA

3.1 The Pole Temple will collect personal data for its client database and will keep this information strictly confidential.

3.3 The Pole Temple will occasionally use personal data to inform clients about events and other activities of the school. If the client does not want to receive these e-mails, s.he can unsubscribe at the bottom of these emails, by clicking on “Unsubscribe”. If a client unsubscribes to the newsletter, s.he will not receive important updates regarding the schedule by email anymore.

4. LIABILITY

4.1 Participation in classes, courses, workshops and camps at The Pole Temple is fully at the clients’ own risk. By agreeing with the Terms and Conditions, the client declares s.he is aware of the risks and accepts this. The Pole Temple is not liable for any injuries, damages or losses due to participation in a class, course, workshop or camp. This applies for open training hours and online courses as well.

4.2 All losses or damages to properties of The Pole Temple and/or the location holder, caused by the client will be the responsibility, financial as well, of the client at all times.

4.3 Because of hygienic reasons the client has the obligation to use a towel to the classes. When the client doesn’t have a towel with her/him, s.he is obliged to rent or buy one at The Pole Temple. If the client refuses to rent or buy a towel, s.he will be denied access to the class, without the possibility of getting a refund.

4.4 The Pole Temple subscribes to a Sports Insurance plan for all regular students. All students with an active membership or 10-Class pass are required to pay the annual insurance fee of 10€. This fee covers them for the current calendar year and is to be paid ultimately on January 31st. Every new student that signs up during the year is required to pay the insurance fee of 10€ in the 7 calendar days following their purchase of a membership or 10-Class Pass, no matter at what time during the year they sign up. The insurance fee cannot be lowered or discounted for any reason whatsoever.

5. CLASSES & MEMBERSHIPS

5.1 The client can only book her/his spot in a class when a class unit, class package or membership has been purchased from the Eversports online booking system.

5.2 The client can make a reservation for a class only online through the platform Eversports. It is not possible to enroll for a class by phone, email, or any other option.

5.3 A 6-hour cancellation policy applies to most classes. Clients that cancel 6 or more hours before the start of the class can choose another moment to use their class credit. In case of a “late cancellation” (when a student cancels less than 6 hours before the start of the class) the fee for the class cannot be refunded and the class will be seen as a participated class. For Saturday classes, the cancellation policy is 24h.

5.4 When the client arrives more than 10 minutes after the start of the class, the teacher has the right to refuse the client access to the class, with no possibility for a refund.

5.5 Class packages and memberships are personal and can not be used by another person or transferred.

5.6 The periodic membership fee has to be paid in advance. When the client has not fulfilled her/his payment obligation in time, s.he might be refused entrance to the class. The membership fee needs to be paid by preauthorized debit authorized by the client.

5.7 The starting date for all memberships is based on the purchase date. The first payment (part of the month or whole month) will be made by Credit Card or Direct Debit (SEPA). The subsequent payments will be made by preauthorized debit on the 1st day of each following month.

5.8 All memberships have a minimum contract period of 3 whole months and cannot be terminated within the initial contract period. The membership fees need to be paid during the complete contract period, whether that is 3, 6 or 12 months. If a client purchases his/her membership later than the 1st day of the month and makes a first partial payment, the contract period of 3, 6 or 12 months will only start on the 1st day of the following month.

5.9 All memberships can be upgraded during the contract period for a minimum period of 2 months. The expiration date of the membership will remain unaltered. Downgrading to the original membership can be done after the 2 months period as described above.

5.10 After the initial contract period of respectively 3, 6 or 12 months, the membership will be automatically extended for 1 month, and will being extended for periods of 1 month each time. After being extended, the client can terminate or request to alter her/his membership with a term of 1 month’s notice. This can be done directly via the client’s account on Eversports (termination), or by e-mail at jessica@thepoletemple.com (request to alter). During the term of notice the client can still enroll for classes at The Pole Temple.

5.11 The Pole Temple will do everything within its power to let classes occur according to schedule. However, classes might be cancelled due to unforeseen circumstances or if there are not enough participants. When this is the case The Pole Temple will inform the client in advance and the client can use the class credit for another class during that month. It will not be possible to receive any refunds.

5.12 If the behavior of a client is deemed unacceptable, The Pole Temple reserves the right to proceed to the extraordinary termination of the membership of the client without warning. Extraordinary termination means that the membership ends right away or on a set date (for example the last day of the month), with no possibility for a refund for the remainder of the month, should there be any credits left. For clients with a 10-Class Pass or any number of other passes, the product’s validity will either be modified or the products will be invalidated with no possiblity for a refund. Examples of unacceptable behavior are: repeated late/refused payments, frequent no-shows, repeatedly not canceling their participation to free up a spot in class, habit of arriving late to class, and any form of disrespect towards the other students, the teachers, or the studio.

6. FEES, PAYMENTS & PRICE CHANGES

6.1 The client is obliged to pay the fee liable before the start of the (first) class. The client can pay using the online reservation system, which uses either Credit Card or Direct Debit (SEPA). After purchasing a membership, all periodic payments after the first online payment will be made by preauthorized debit. The client will agree to this preauthorized debit by completing the registration form.

6.2 After online registration for a membership and agreeing to the Terms and Conditions the client agrees to a continuous preauthorized debit to The Pole Temple. The client has the choice of a membership with a contract period of either 3, 6 or 12 months, which all cannot be terminated before the end of the contract period.

6.3 When a client doesn’t comply with the payment requirements, The Pole Temple may refuse services to the client and, if necessary, bring in a collection agency.

6.4 The Pole Temple has the right to change fees. Price changes will be announced in advance on the website and/or by e-mail.

6.5 The client needs to make sure that payments occur without issues. Every time a student's credit card payment doesn't go through or is refused, for whatever reason, a chargeback fee of 5€ will be added to the student's next invoice. The student will always be warned by email when this is the case.

7. ABSENCE & VACATIONS

7.1 The Pole Temple may be closed on bank holidays and may have an adapted schedule in the holiday periods. This will not lead to a reduction or refund of membership fees. Adapted schedules and cancellations will be announced in advance on the website and/or by e-mail.

7.2 When a client has a long-term illness or injury, The Pole Temple may consider a temporarily stop of a membership or class package, when s.he can submit a Doctor’s statement.

7.3 The client may request to freeze the contract when s.he goes on holiday. Freezing the contract will only be possible with a 6-month or 12-month membership and only for the duration of 1 whole month, two times a year maximum. Requests for freezing the contract must be made by e-mail at jessica@thepoletemple.com at least 2 weeks in advance before the beginning of the month the client wishes to freeze. When the request is made later than 2 weeks in advance, a penalty fee of 15€ will incur.

7.4 In the event of a month-long complete closing of the studio where classes are not being held, all memberships will be paused and the validity of all products will be extended by one month.

8. WORKSHOPS, COURSES & CAMPS

8.1 The client can participate in scheduled workshops, courses or camps by enrolling in advance at The Pole Temple and pay the required fee. Reservations for workshops can be made only online through the online reservation system.

8.2 Cancellation of a reservation for a workshop, course or camp is not possible. When the payment has been made, the reservation will be definite. The Pole Temple will always try its best to have a waiting list for workshops, camps and other events. If the client wants to cancel her/his reservation, s.he can try to find another person to take the spot. Only in this case will a refund be possible.
